Overview
The Partner visa (subclass 309 and 100) allows the spouse or de facto partner of an Australian citizen, permanent resident or eligible New Zealand citizen to live in Australia. This is the offshore version of the partner visa for applicants outside Australia.

Eligibility Requirements
- You must:
- Be the spouse or de facto partner of an Australian citizen, permanent resident, or eligible New Zealand citizen
- Have a genuine and continuing relationship
- Be sponsored by your partner
- Meet health and character requirements
- Be outside Australia when you apply and when the temporary visa is granted
Application Process
Your partner submits sponsorship application
Apply for temporary (309) and permanent (100) visas together
Provide relationship evidence (photos, joint finances, statements)
Complete health examinations
Police checks from all countries lived in for 12+ months
Receive temporary visa (309)
After about 2 years, assessment for permanent visa (100)

- 309 Visa Application - NIL for any applicants
- 100 Visa - main applicant: $11,710
- 100 Visa - additional applicant over 18: $5,860
- 100 Visa - additional applicant under 18: $2,935
Processing Times
Temporary stage (309):
75% of applications: 17 months
90% of applications: 30 months
Permanent stage (100):
75% of applications: 10 months
90% of applications: 19 months
Restrictions & Conditions
- Must be outside Australia when applying
- Must maintain genuine relationship
- Two-year waiting period for permanent visa
- Cannot add children after lodgement
- Sponsor can only sponsor two partners in lifetime (with exceptions)
Additional Information
If you are in a prospective marriage visa (subclass 300), you can apply for this partner visa after you get married. Same-sex relationships are treated equally to opposite-sex relationships.
