Overview

The Partner visa (subclass 820 and 801) is a two-stage visa that allows the spouse or de facto partner of an Australian citizen, permanent resident or eligible New Zealand citizen to live in Australia. You apply for the temporary and permanent partner visas together.

  • You must:
  • Be the spouse or de facto partner of an Australian citizen, permanent resident, or eligible New Zealand citizen
  • Have a genuine and continuing relationship
  • Be sponsored by your partner
  • Meet health and character requirements
  • Be in Australia when you apply

Your partner (sponsor) submits sponsorship application

You apply for both temporary (820) and permanent (801) visas together

Provide evidence of genuine relationship

Undergo health examinations

Receive temporary visa (820)

After 2 years, automatic assessment for permanent visa (801)

  • 820 visa application: NIL for any applicants
  • 801 Visa - main applicant: $11,710
  • 801 Visa - additional applicant over 18: $5,860
  • 801 Visa - additional applicant under 18: $2,935

Restrictions & Conditions

  • Must maintain genuine relationship with sponsor
  • Two-year waiting period before permanent visa grant
  • Cannot add dependent children after visa is lodged
  • Must be in Australia when applying and when temporary visa is granted

Additional Information

If your relationship breaks down due to domestic violence, you may still be eligible for the permanent visa. Special consideration is given to these cases.
